Rental conditions of the vacation apartments Ambiente an der Elbe, Kötzschenbroder Straße 18 in 01139 Dresden and the vacation apartment Am Theaterplatz in 01662 Meißen

Contractual partners: Contractual relationships arise between Ruth and Tobias Erz (landlord) or Tobias Erz, T. Erz GmbH and the tenant.

Conclusion of the rental agreement: With the booking, which can be made verbally, in writing, by telephone, fax or e-mail, you make a binding offer to the landlord to conclude a rental agreement. The rental agreement between the landlord and the tenant is concluded when we confirm the booking. It shall be made exclusively in writing by letter or e-mail.

Payment: A deposit is not required, the total price must be credited to our account 3 weeks before arrival.

Arrival and departure times: Unless otherwise agreed, the rented apartment is available from 4:00 p.m./5:00 a.m. on the day of arrival until 10:00 a.m. on the day of departure. Arrivals and departures during the usual quiet hours (10 p.m. to 7 a.m.) should be avoided wherever possible.

Cancelationby the tenant: Until the start of the rental period agreed in the booking, the customer may only withdraw from the booking by submitting a written declaration to the lessor. The time of receipt of the declaration of withdrawal shall be decisive.

  • The following cancellation costs apply: Cancellation from 2 months before the start of the rental period: 20% of the rental price.
  • Cancellation from 1 month before the start of the rental period: 50% of the rental price.
  • Cancellation from the 14th day before the start of the rental period: 80% of the rental price

We recommend that you take out travel cancellation insurance.

Cancellation by the landlord: The landlord is obliged to make the rented vacation apartment available for the booked period. Otherwise, he must pay the tenant compensation in accordance with the statutory provisions. If the vacation apartment is not made available, the landlord is obliged to reimburse the tenant in full for any payments already made.

The obligations of the tenant

  • Tenants are requested to comply with the house rules and to treat the rented property with care. The tenant is liable for damage caused by gross negligence.
  • The vacation apartments are non-smoking apartments. Please go outside to smoke.
  • Defects in the rented property must be reported immediately and the tenant must be given the opportunity to rectify the defects. Withdrawal and/or termination by the tenant is only permitted in the event of significant defects, unless a reasonable remedy has been provided within a reasonable period set by the tenant.
  • The tenant is liable for the full cost of replacing lost keys and opening the door.
  • The apartment may only be occupied by the number of persons agreed in the booking. Over-occupancy may entitle the vacation apartment owner to terminate the contract immediately or to charge an appropriate additional fee.

Severability clause: Should individual provisions be invalid, the remaining provisions shall remain unaffected. The contracting parties shall then endeavor to find a permissible provision that comes as close as possible to the intended provision.

Choice of law and place of jurisdiction: The place of jurisdiction is exclusively the court responsible for the place of residence of the owners. The entire legal and contractual relationship between the apartment owners and guests who do not have a general place of residence or business in Germany shall be governed exclusively by German law.
